JustHire Terms of Use
Effective date: 1 Janaury 2025
These Terms of Use (“Terms”) are an agreement between you and Veritas Crescent LLC, doing business as JustHire (“JustHire”, “we”, “us”), a Delaware limited liability company at 8 The Green, Suite D, Dover, Delaware 19901, United States. They apply when you:
- visit justhire.ai or any of its subdomains (the “Website”); or
- complete a JustHire assessment as a candidate, after being invited by an employer that uses our service (the “Assessment Platform”).
They do not apply to organisations that use JustHire under a signed agreement with us, or to their users when acting for that organisation. That agreement, and our Data Processing Agreement, govern their use instead.
By using the Website or the Assessment Platform, you agree to these Terms and confirm you have read our Privacy Policy. If you do not agree, do not use them.
Please read section 7 carefully. If you are in the United States, it requires disputes to be resolved by individual arbitration and waives class actions, unless you opt out within 30 days.
1. Using the Website
You may use the Website to learn about JustHire and to contact us or request a demo. You must be at least 18, or the age of majority where you live, to use the Website.
2. Candidate assessments
2.1 Who runs the process. You are invited to an assessment by an employer that uses JustHire. The employer decides which questions and tests to use, reviews your results and makes every hiring decision. JustHire provides the technology and is not a party to any hiring decision or employment relationship. Completing an assessment does not guarantee an interview or a job.
2.2 How AI is used. Before you start, we explain how AI is used and what it evaluates, and ask for your consent. You can ask for reasonable accommodations, or an alternative assessment reviewed by a person without AI scoring, by emailing support@justhire.ai. Our Privacy Policy explains this in full.
2.3 What you agree to. When you complete an assessment, you agree to:
- complete it yourself, without anyone else answering for you or helping you in real time;
- give honest answers that reflect your own experience;
- not use AI tools, scripts or other people to generate or read out your answers, unless the employer allows it;
- not record, copy, share or publish the interview questions or tests; and
- not try to interfere with the recording, scoring or security of the assessment.
If you do not follow these rules, the employer may disregard your assessment, and we may tell the employer why.
2.4 Technical requirements. You need a device with a camera, microphone and a supported browser, and a stable internet connection. If something goes wrong during your interview, contact support@justhire.ai or the employer.
3. Acceptable use, intellectual property and your content
3.1 Acceptable use. You must not, or help anyone else to:
- copy, reverse engineer, decompile or try to extract the source code, models or algorithms behind the Website or Assessment Platform;
- scrape, crawl or collect data from them, or use them to build a competing product;
- interfere with their security or operation, or introduce viruses or other harmful code;
- access accounts, assessments or data that are not yours;
- use them to send unsolicited commercial email, or for anything unlawful, fraudulent or harmful; or
- upload anything that infringes someone else’s rights, or is threatening, obscene or defamatory.
3.2 Our intellectual property. JustHire and its licensors own the Website, the Assessment Platform, and all content, software, question libraries and materials in them. We give you a limited, personal, non-transferable right to use them only as these Terms allow. All other rights are reserved.
3.3 Your content. You keep ownership of your interview answers, recordings and anything else you submit. You give JustHire permission to host, store, transcribe, analyse and share that content with the employer who invited you, only to provide the assessment and as our Privacy Policy describes. We never use your content to train AI models.
3.4 Feedback. If you send us suggestions about our products, we may use them without any obligation to you.
4. Privacy and third-party links
4.1 Privacy. Our Privacy Policy explains how we collect and use personal information. For candidate information, the employer who invited you is responsible for how it is used in their hiring process.
4.2 Third-party links. The Website may link to other websites. We are not responsible for their content or privacy practices.
5. Disclaimers
5.1 The Website and Assessment Platform are provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that they will be uninterrupted, error-free or free of harmful components.
5.2 AI results. Fit scores and explanations are tools to support the employer’s own review. They may not be complete or accurate, and they are not a judgement of your worth or ability. JustHire does not make hiring decisions, and is not responsible for decisions an employer makes.
5.3 Some places do not allow certain warranties to be excluded. In those places, the exclusions above apply only as far as the law allows, and nothing in these Terms affects your statutory rights as a consumer.
6. Liability, indemnity and suspension
6.1 Limitation of liability. To the fullest extent the law allows, JustHire will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of, or inability to use, the Website or Assessment Platform. Our total liability to you for all claims is limited to US$100.
6.2 What we do not limit. Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited by law. If you are a consumer in the UK or EU, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care.
6.3 Indemnity. If you use the Website for a business, you will compensate JustHire for claims, losses and reasonable legal costs arising from your breach of these Terms or misuse of the Website. This does not apply to consumers or to candidates completing an assessment.
6.4 Suspension. If you break these Terms, we may suspend or block your access to the Website or an assessment, and tell the employer where relevant. We may also seek an injunction or other urgent relief from a court.
7. Disputes and governing law
7.1 Talk to us first. If you have a dispute with us, email support@justhire.ai with a description of it. We will try to resolve it informally within 60 days, and ask that you do the same for us before starting any formal proceedings.
7.2 Arbitration (United States). If you live in the United States and we cannot resolve a dispute informally, it will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, or its Commercial Arbitration Rules if you use the Website for a business. Arbitration may be held by video, or in the county where you live. For consumer claims, we will pay the AAA filing and arbitrator fees beyond what you would pay to file in court.
7.3 Exceptions. Either of us may bring a claim in small claims court, or ask a court for an injunction to protect intellectual property or stop misuse of our services.
7.4 Class action waiver. Disputes will be resolved only on an individual basis. Neither of us may bring or take part in a class, collective or representative action. If 25 or more similar arbitration demands are filed by or with the help of the same law firm or organisation, they will be administered in batches under the AAA’s mass arbitration procedures.
7.5 Opting out. You can opt out of arbitration and the class action waiver by emailing support@justhire.ai within 30 days of first accepting these Terms, with your name and a statement that you are opting out. Opting out does not affect any other part of these Terms.
7.6 Outside the United States. Sections 7.2 to 7.5 do not apply to you. If you are a consumer in the UK or EU, you can bring proceedings in the courts where you live, and you keep the protection of your local consumer laws.
7.7 Governing law. These Terms are governed by the laws of the State of Delaware and the US Federal Arbitration Act, without regard to conflict-of-law rules. Subject to section 7.2 and 7.6, disputes will be heard in the state or federal courts located in Delaware.
8. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page with a new effective date. Changes apply from that date, except that changes to section 7 will not apply to disputes you have already told us about. If you keep using the Website or Assessment Platform after a change, you accept the updated Terms.
9. General
- Entire agreement. These Terms and our Privacy Policy are the whole agreement between you and us about the Website and Assessment Platform.
- Severability. If any part of these Terms cannot be enforced, the rest still applies.
- No waiver. If we do not enforce a right straight away, we can still enforce it later.
- Assignment. You may not transfer your rights under these Terms. We may transfer ours, for example as part of a merger or sale of our business.
- Events outside our control. We are not responsible for delays or failures caused by events outside our reasonable control.
- Export and sanctions. You may not use the Website or Assessment Platform if you are located in, or ordinarily resident in, a country subject to US sanctions, or are on a US government restricted-party list.
